This Refund and Dispute Policy is an addendum to the Terms and Conditions that govern the use of website jokesonus.lol and services pertaining to the game “JOKE's ON US” accessible on various platforms such as game consoles, personal computers, mobile devices, television sets (“Services”). 1. Refunds

1.1. All services provided by us are non-refundable. However, in the case of a technical error during payment processing, Gmonks will refund the incorrectly processed amount, provided the customer notifies Gmonks at contacts@gmonks.com within 72 (seventy-two) hours of the payment processing. The refund will be processed within 5-10 business days, depending upon the bank.
1.2. Where any federal or state consumer protection legislation in your jurisdiction applies and
cannot be excluded, the Terms and Conditions will not limit your legal rights and remedies
under that legislation. Specifically, the Terms and Conditions comply with the Federal Trade
Commission Act, as well as applicable state consumer protection laws. If there is a conflict
between the Terms and Conditions and such legislation, the mandatory provisions of the
legislation will apply.
1.3. Refunds for digital purchases will be governed in accordance with the applicable laws of your
state. Please note that refunds may not be provided for services once accessed, except where
required by law.
1.4. Our Services may be availed via Third Party platforms that we do not own or control. We are
not responsible for the content, policies or practices of any third-party website or services
linked to our Services. It is your responsibility to read the terms and conditions and privacy
policies of these third party websites before using these Services.
2. Dispute Resolution
2.1. Preliminary Dispute Resolution Before initiating any formal legal proceeding, the parties agree to:
- Attempt to resolve disputes through good-faith negotiation
- Provide written notice of any dispute, describing its nature and requested relief
- Engage in a 30-day informal resolution period
2.3. Arbitration Terms:
- Arbitration will be conducted by a single neutral arbitrator
- The arbitration will be held in the federal judicial district where the user resides
- The arbitrator shall have the authority to grant any remedy available under applicable law
- The arbitration process shall be confidential
Notwithstanding the arbitration provision, either party may seek relief in small claims court or pursue injunctive relief in court for:
- Intellectual property protection
- Urgent equitable relief necessary to prevent irreparable harm
- Claims that do not exceed the jurisdictional limit of small claims court
Users may opt-out of this arbitration agreement by:
- Sending a written opt-out notice to Gmonks within 30 days of first using the Game
- Providing a clear statement of intent to opt-out
- Sending the notice to the official contact address specified in the Terms and Conditions
To the fullest extent permitted by law:
- Any proceedings shall be conducted on an individual basis only;
- Class action, collective action, and consolidated proceedings are expressly waived;
- If a court determines that this waiver is unenforceable, the entire arbitration provision may be deemed invalid.
If any portion of this dispute resolution section is found to be unenforceable:
- That specific provision will be modified to the minimum extent necessary to make it enforceable
- All other provisions remain in full force and effect.
This dispute resolution provision shall be governed by the Federal Arbitration Act and applicable federal law.
